UK Spouse Visa Accommodation Requirements (2025)
This page has been reviewed and verified by Michael Gibbons, UK Solicitor and Regulated Immigration Advisor, to ensure accuracy under current UK immigration policy. Confirm your visa requirements via Our UK Visa Guidance.
To qualify for a UK Spouse Visa, applicants must demonstrate that suitable accommodation is available for themselves, their partner, and any dependants. This rule ensures compliance with Home Office housing standards and prevents the need for public assistance. As of October 2025, all applicants must show proof of adequate and exclusive living arrangements in the UK.
What Does “Adequate Accommodation” Mean?
Under UK immigration policy, accommodation is considered adequate if it:
- Is owned or occupied exclusively by the applicant and their partner.
- Meets the UK’s overcrowding and housing health standards.
- Is not provided at public expense (i.e., not subsidised by the government).
- Is legally available for the couple’s use for the full duration of their stay.
Meeting this requirement is essential. Even if you satisfy the financial requirement and English language requirement, your application may still be refused if accommodation details are insufficient.
Types of Acceptable Accommodation
- Owned property — a home owned outright or with a mortgage in the sponsor’s or applicant’s name.
- Rented property — must include a valid tenancy agreement with consent for the applicant to reside.
- Family accommodation — acceptable if the property owner provides a written statement confirming the applicant may live there.
For further proof documentation, review our Spouse Visa Document Checklist (2025).
Evidence You’ll Need
Applicants should include clear, recent, and verifiable evidence of accommodation. The Home Office typically expects the following:
- Title deeds or mortgage statements (if owned property).
- Tenancy agreement (minimum 6 months validity recommended).
- Letter of consent from property owner (if staying with family or friends).
- Recent council tax or utility bills.
- Property inspection report (if requested by Home Office).
| Accommodation Type | Required Evidence | Additional Notes |
|---|---|---|
| Owned Home | Title deed, mortgage statement, utility bills | Must show exclusive access and suitable living space |
| Rented Property | Tenancy agreement, letter from landlord | Applicant’s name must appear or permission included |
| Family Property | Letter of consent, proof of ownership, inspection report | Include evidence of relationship with homeowner |
Overcrowding Rules
Accommodation must not breach Part X of the Housing Act 1985, which defines overcrowding by the number of rooms and occupants. Typically, a property is suitable if:
- Each couple or adult has their own room.
- Children under 10 can share with parents or siblings of the same gender.
